1. Acceptance of Terms

By downloading, accessing, or using the Rue: Find Your Instructor mobile application and the Rue website (together, “Rue,” “the Platform,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Platform.

These Terms constitute a legally binding agreement between you and Rue. Please also review our Privacy Policy, which is incorporated into these Terms by reference.

2. Eligibility & Age Requirement

You must be at least 16 years of age to use Rue. By using the Platform, you represent and warrant that you are 16 or older and that you have the legal capacity to enter into these Terms. If you are between 16 and the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

We do not knowingly permit anyone under 16 to use the Platform. If we learn that a user is under 16, we may suspend or remove the account.

3. Your Account

When you create an account, you agree to:

  • Provide accurate and complete information
  • Keep your login credentials secure and confidential
  • Be responsible for all activity that occurs under your account
  • Notify us immediately of any unauthorized use of your account

You may sign in using email, Apple Sign-In, or Google Sign-In. You are responsible for maintaining the security of whichever method you choose. We are not liable for any loss arising from unauthorized use of your account.

4. User Roles

Rue serves three types of users — students, instructors, and studios. Each role has different features and responsibilities:

  • Students may follow instructors, view schedules, and message instructors
  • Instructors may post class schedules, share updates, manage their profile, and message students
  • Studios may manage their profile and instructor affiliations

You agree to use your account only for its intended purpose and in accordance with the role you select. You are responsible for the accuracy of the information you provide about yourself, your classes, and your credentials.

5. Rue Is a Platform, Not a Provider

Rue is a discovery and communication platform that connects students with fitness instructors and studios. Rue does not provide fitness classes, instruction, or training, and is not a party to any arrangement, booking, or transaction between users.

Rue does not employ, endorse, supervise, or guarantee any instructor, studio, or student. We do not verify the qualifications, certifications, licensing, or background of any user, and we make no representations about the quality, safety, or legality of any class or the conduct of any user. Any arrangements you make with an instructor or studio are solely between you and them, and you engage with other users at your own risk.

6. Assumption of Risk & Health Disclaimer

Physical exercise carries inherent risks, including the risk of serious injury. By using Rue to discover or attend classes, you acknowledge and agree that:

  • You participate in any fitness class or activity entirely at your own risk
  • You are solely responsible for determining whether a class is appropriate for your fitness level and health
  • You should consult a physician before beginning any new exercise program
  • Rue is not responsible for any injury, harm, or loss arising from your participation in any class or activity, or from your interactions with any instructor or studio

Rue does not provide medical advice. Any wellness or fitness information in the app is for general informational purposes only and is not a substitute for professional medical guidance.

7. User Content

Instructors, studios, and users may post content including class schedules, announcements, messages, profile information, and other materials (“User Content”). You retain ownership of your User Content, but you grant Rue a non-exclusive, worldwide, royalty-free license to host, display, and distribute it within the Platform for the purpose of operating and promoting the service.

You are solely responsible for your User Content and represent that you have the rights to post it and that it does not violate these Terms or any law. You agree not to post content that is unlawful, false, misleading, harmful, harassing, threatening, defamatory, obscene, infringing, or that violates the rights or privacy of others.

8. Acceptable Use

You agree not to:

  • Use the Platform for any illegal or unauthorized purpose
  • Harass, abuse, threaten, stalk, or harm other users
  • Impersonate any person or entity, or misrepresent your affiliation
  • Post spam, false, or misleading information
  • Solicit personal or financial information from other users
  • Use the Platform to contact minors for any improper purpose
  • Attempt to gain unauthorized access to the Platform or its systems
  • Interfere with, disrupt, or overload the Platform's functionality
  • Scrape, copy, harvest, or collect data from the Platform without our written permission
  • Transmit any virus, malware, or harmful code

Violating these rules may result in suspension or termination of your account.

9. Content Moderation & Zero Tolerance for Objectionable Content

We have zero tolerance for objectionable content or abusive behavior. By using the Platform, you agree that there is no tolerance for objectionable content or abusive users. We reserve the right, but assume no obligation, to monitor, review, remove, or restrict any User Content or account at our discretion, with or without notice. To keep our community safe:

  • Report content: You can report objectionable content or a user at any time directly from a user's profile or from Settings → Help & Support → Report.
  • Block users: You can block any user from their profile or from Settings → Privacy & Security → Blocked Users. Blocked users can no longer message you or see your activity.
  • Our response: We review reports of objectionable content and will remove the content and eject the offending user within 24 hours where warranted.

Because Rue hosts content created by users, we are not responsible for User Content and do not endorse any opinions, recommendations, or information expressed by users. If you encounter content or conduct that violates these Terms, you can also report it to us at support@join-rue.com, and we will review reports in good faith. While we strive to maintain a safe community, we cannot and do not guarantee that we will identify or remove all objectionable content.

10. Intellectual Property & Copyright

The Rue name, logo, design, and all related content (excluding User Content) are the property of Rue and are protected by intellectual property laws. You may not use, copy, or reproduce any part of the Platform without our written permission.

We respect intellectual property rights and respond to notices of alleged copyright infringement consistent with the Digital Millennium Copyright Act (DMCA). If you believe content on Rue infringes your copyright, please send a notice to our designated copyright agent at support@join-rue.com including: a description of the work, the location of the allegedly infringing material, your contact information, a statement of good-faith belief that the use is unauthorized, and a statement that the information is accurate and that you are authorized to act. We may remove infringing material and terminate repeat infringers.

11. Third-Party Services

Rue uses third-party services including Google Maps, Google Places, Apple Sign-In, Google Sign-In, and Supabase. Your use of these features may be subject to the respective third parties' terms and policies. Rue is not responsible for the practices of any third-party service.

12. Disclaimers

The Platform is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Rue does not warrant that the Platform will be uninterrupted, error-free, secure, or that any information (including class times, schedules, or studio details) is accurate, complete, or current. You use the Platform at your own risk.

13. Limitation of Liability

To the fullest extent permitted by law, Rue and its owners, operators, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or for personal injury, arising out of or relating to your use of the Platform, your interactions with other users, or your participation in any class or activity, whether based on warranty, contract, tort, or any other legal theory, even if advised of the possibility of such damages. In no event shall Rue's total liability to you for all claims exceed one hundred U.S. dollars ($100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless Rue and its owners, operators, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Platform, your User Content, your violation of these Terms, or your violation of any rights of another person or entity.

15. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if you violate these Terms or engage in conduct we deem harmful to the Platform or its users. You may delete your account at any time through the app (Settings → Account → Delete Account) or by contacting support@join-rue.com. Provisions that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and dispute resolution) will survive.

16. Dispute Resolution & Arbitration

Please read this section carefully, as it affects your legal rights.

Most concerns can be resolved informally. Before filing a claim, you agree to first contact us at support@join-rue.com and attempt to resolve the dispute with us in good faith for at least 30 days.

If we cannot resolve a dispute informally, you and Rue agree that any dispute arising out of or relating to these Terms or the Platform will be resolved through binding individual arbitration, rather than in court, except that either party may bring a claim in small-claims court. You and Rue waive the right to a trial by jury and to participate in any class action. Disputes will be resolved on an individual basis only.

This arbitration agreement does not prevent you from bringing issues to the attention of government agencies. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing us with a clear statement of your intent to opt out.

17. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law principles. Subject to the arbitration section above, any disputes not subject to arbitration shall be brought in the state or federal courts located in Florida, and you consent to their jurisdiction.

18. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by updating the “Last updated” date above and, for material changes, by asking you to review and re-accept the updated Terms within the app before you continue using it. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

19. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision is not a waiver of that right. These Terms are the entire agreement between you and Rue regarding the Platform and supersede any prior agreements.
